An appeals court on Thursday, Oct. 9, upheld a woman’s 2012 drunk driving conviction.

Michelle Lynch was found guilty of driving while intoxicated on March 6, 2011 in Paulsboro in a municipal court hearing on April 16, 2012.

Lynch argued she she should have been granted a postponement of her trial and that there was no evidence she refused to undergo a breath test or that she was a drunken driver.

At her municipal hearing, Lynch did indicate she wanted a medical expert to testify that she has asthma, and that asthma could have prevent dyer from being able to successfully complete a breath test.

But no formal request was made for the postponement, according to Assistant Gloucester County Prosecutor Margaret Cipparrone, and no medical report was produced.

Proof beyond a reasonable doubt that Lynch drove drunk came from two witnesses who testified a woman in an SUV almost hit their vehicle on Interstate 295 in West Deptford before exiting and hitting a drawbridge in Paulsboro, according to Cipparrone.

The couple’s 911 call resiled in Lynch being arrested by a police officer who reported she smelled of alcohol, had slurred speech and denied she’d hit anything with her SUV.
